These Terms of Service (“Terms”) govern your access to and use of the services provided by Cart Push'r LLC (“Cart Push'r,” “we,” “our,” or “us”).

By using our services, you agree to these Terms.
 

1. Services Overview

Cart Push'r provides a performance-based cart recovery service that uses browser push notification technology to re-engage website visitors and recover abandoned carts.
 

2. Eligibility

You must be at least 18 years old and authorized to enter into a binding agreement on behalf of your business to use our services.
 

3. Client Responsibilities

Clients agree to:

• Provide accurate business and billing information

• Ensure they have the right to install tracking scripts on their website

• Comply with all applicable laws, including data privacy regulations

• Maintain proper disclosures to their website users regarding data collection and push notifications
   

4. Fees and Payment Terms

• A one-time setup fee applies unless otherwise agreed

• Cart Push'r charges a commission on revenue generated through our services

• Invoices are issued monthly and are due within 7 days (Net 7)

• Late payments may result in suspension of services
   

5. Revenue Attribution

Cart Push'r uses its internal tracking systems to attribute recovered revenue. Clients agree that Cart Push'r’s reporting will be the basis for invoicing unless otherwise agreed in writing.
 

6. Intellectual Property

All technology, software, and systems provided by Cart Push'r remain the property of Cart Push'r LLC.

Clients retain ownership of their own brand, website, and customer data.
 

7. Acceptable Use

Clients may not:

• Use the service for unlawful or deceptive purposes

• Interfere with system integrity or performance

• Attempt to reverse engineer or replicate the service
   

8. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation.
 

9. Limitation of Liability

To the maximum extent permitted by law, Cart Push'r shall not be liable for:

• Indirect or consequential damages

• Loss of profits or revenue beyond fees paid to Cart Push'r
   

10. Termination

Either party may terminate the agreement at any time with written notice.

Upon termination:

• Services will cease

• Any outstanding invoices remain due
   

11. Modifications

We may update these Terms from time to time. Continued use of the service constitutes acceptance of updated Terms.
 

12. Governing Law

These Terms shall be governed by the laws of the Commonwealth of Pennsylvania, United States.
